Who are we?

This website is owned and operated by TEXTRAPLUS AG. This privacy notice informs you about how we process personal data in connection with our online services.

Our online services are subject to Swiss data protection law, as well as any applicable foreign data protection legislations, such as the European Union’s (EU) General Data Protection Regulation (GDPR). The EU recognises that Swiss data protection law ensures adequate data protection.

Processing of personal data

Personal data comprises all information relating to an identified or identifiable person. A data subject is an individual whose personal data can be collected and processed. Processing means the handling of personal data by any means, in particular the storage, disclosure, acquisition, deletion, storage, modification, destruction and use of personal data.

We process the personal data required for the effective, user-friendly, permanent, secure and reliable provision of our online services. We process personal data only with the consent of the person concerned, unless the processing is permitted for other legal reasons. Processing without consent may be permissible, for example, for the performance of a contract with the data subject and for corresponding pre-contractual measures, in order to protect our overriding legitimate interests, because the processing is evident from the circumstances or after prior information. In this context, we process, in particular, information that is provided by the data subject themselves when contacting us – for example, by letter, e-mail, contact form or telephone.

We process personal data for the duration that is required for the respective purpose or purposes. In the case of longer-term retention obligations arising from legal and other obligations to which we are subject, we restrict processing accordingly.

Legal basis for the processing of personal data

We process personal data in accordance with Swiss data protection law, in particular the Federal Act on Data Protection (FADP).

If and insofar as the GDPR applies, we process personal data in accordance with the following legal bases:

  • 6, section 1 (a) of the GDPR, for the processing of personal data with the consent of the data subject.
  • 6, section 1 (b) of the GDPR, for necessary processing for the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior to entering into a contract.
  • 6, section 1 (c) of the GDPR, for necessary processing for compliance with a legal obligation to which we are subject according to any applicable EU law or any applicable law of a country in which the GDPR applies, either wholly or in part.
  • 6, section 1 (d) of the GDPR, for necessary processing to protect the vital interests of the data subject or of another natural person.
  • 6, section 1 (f) of the GDPR, for necessary processing for the purposes of the legitimate interests pursued by ourselves or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject. Legitimate interests are our business interests in being able to provide and advertise our online services, information security, as well as the prevention of misuse and unauthorised use, the enforcement of our own legal claims and compliance with Swiss law.

Rights of data subjects

Data subjects whose personal data we process have rights in accordance with Swiss data protection law. These include the right to information about the processed data as well as the right to correct, delete or block this data.

If and insofar as the GDPR applies, data subjects whose personal data we process may obtain confirmation, free of charge, as to whether we process their personal data and, if so, request information on the processing of their personal data, have the processing of their personal data restricted, exercise their right to data portability and have their personal data corrected, erased (“right to be forgotten”) or blocked.

If and insofar as the GDPR applies, data subjects whose personal data we process can withdraw the consent they have given at any time and object to the processing of their personal data at any time.

Data subjects whose personal data we process have the right to lodge a complaint with a supervisory authority. The supervisory authority for data protection in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC).

We also voluntarily grant the aforementioned rights of data subjects pursuant to the GDPR to data subjects in Switzerland.
